THE COLLISION OF CHURCH AND STATE Updated

A firestorm has erupted over the Obama administration's enforcement of yet another of those little goodies Nancy Pelosi promised we'd find out about eventually.  In one more in a laundry list of examples of the contempt in which they hold the Constitution, the administration is subjugating the first amendment to birth control.  Pelosi has dismissed claims of unprecedented violations of constitutionally protected religious liberty as merely an "excuse". The way they talk, you'd think women who worked for Catholic institutions were physically restrained from purchasing birth control.  Well, except for the 98% of catholic women who use birth control, of course.

That's right, they are attempting to use opposing straw men (straw women?) to support their attack.  On the one hand, the women are being victimized, unable to be truly healthy because they don't have employer-paid access to IUDs and the abortion pill.  The way they talk, birth control pills are a cross between super vitamin and miracle cure.  On the other, all catholic women are on birth control and owe their lives and fortunes to their ability to be parasite baby free.  But ultimately, if you oppose this measure, you are a troglodyte who wants to take women back to the stone age just because you are a mean old meany head.  And paranoid.

Push back to these bogus arguments has been quick and vehement, and completely dismissed or misunderstood.  What is being forgotten is that trying to explain the impact it will have on people of faith is a wasted argument, because it would require politicians and media ideologues to understand morals, principles and answering to a higher power.  Please note the high level of derision on the left in regards to the issue of the violation of our religious freedoms.  Attempting to make people feel silly for believing something might work in politics, but it is much less effective in matters of faith.

They can muddy the waters all they want, but it's pretty evident that this is all about placing the diktats of the state over the church's fundamental tenets.  Under this administration, the much-vaunted separation of church and state is apparently a one-way street.

I could spend time arguing about the war on Christianity in this country, but this is far more cut and dried, and it is something every American, regardless of religion, should think deeply about.  This is a full frontal assault on our religious freedom, no matter what that religion is.  Demanding that the catholic church ignore a fundamental article of faith - the sanctity of life - in order to comply with the requirements of the state is exactly why our founders created the first amendment.  It wasn't to protect the State from the Church as we have been led to believe over the past few decades as much as it was to protect the Church from the State.  According to Thomas Jefferson, in his letter to the Danbury Baptist Association in 1802 in an effort to clarify the issue (emphasis mine):

Believing with you that religion is a matter which lies solely between Man & his God, that he owes account to none other for his faith or his worship, that the legitimate powers of government reach actions only, & not opinions, I contemplate with sovereign reverence that act of the whole American people which declared that their legislature should "make no law respecting an establishment of religion, or prohibiting the free exercise thereof," thus building a wall of separation between Church & State.

The phrases I emphasized, "that the legitimate powers of government reach actions only, & not opinions" and "prohibiting the free exercise thereof" are key to this argument because the Obama administration is demanding that the Church change its long-held belief and opinion that contraception and especially abortion are against the will of God.  This has been a teaching of the church for centuries; it is a matter of conscience, not convenience, to be tossed aside on a whim - or mandate.  By forcing religious entities to fund such things, they are unable to freely exercise their religious conscience.  It is a clear violation of our founding document.

The Constitution is being tested as never before under this regime (yes, regime). While most of the other power grabs under this president have been swept under the carpet, this is an affront on an epic scale.  The attempts by the media and various administration personnel to argue that this is about "right-wing radicals" trying to take away women's right to birth control or don't want them "healthy" has done nothing to blur the issue.  People don't buy the argument that women can't get birth control if they want it.  We all know it can be gotten at any pharmacy in this country.  As for the poor, well, isn't that what left-wing darling Planned Parenthood is all about?  The argument that the Pill saves women from ovarian cancer is an interesting argument, if you want to totally disregard the fact that the pill also increases your chances of getting breast, cervical and liver cancer.  Please note, too, that those who are championing this abomination studiously avoid the topic of abortifacients such as the 'morning after' pill.  Making the topic only about contraception is a deceptive little ploy to cloud the issue and attempt to get concessions.  Oh, its just contraception we're talking about, what's the big deal about that?

We the People may be a little lethargic, a little pre-occupied, maybe even a little numbed by all that has happened to us in the past decade, but we're not blithering idiots.

If there's one thing We the People know, it's our rights, and we don't like having them taken away.  Spin it however you want, we know when our rights are being stripped from us.

No doubt there will be a rash of polls from such unbiased bastions of propaganda information as the Washington Post (who no longer publishes poll data) and the New York Times in the next few days that will support the administration's actions in an attempt to legitimize this assault on our liberty.  There usually is these days.  But the thing is, on the subject of faith, people are going to believe their lying hearts before they allow a political poll to dictate their conscience.

The argument I'm hearing most often is whether the administration's many missteps, over-reaches,  and overall disregard for the rights and freedoms of the American people is a product of incompetence or design.  The refusal of the President to back down on this points to design, particularly when combined with his protestations of dissatisfaction over the years with the "negative" structure of the Constitution.  But even still, the best-case scenario - the argument for incompetence-  is being used far too frequently in this administration and brings up a plethora of other issues in it's wake, most rightly involving suitability for reelection.

In an attempt at "compromise", the administration offered to grant a one-year waiver to come into compliance.  How generous of them, to offer an extra twelve months to come to terms with betraying a belief system that has stood for thousands of years.

On a side note, am I the only one who has noticed that "compromise" under this administration has meant bowing fully to their demands?  These people need not only a copy of the Constitution, but a dictionary.

And now the administration has come out with a new "compromise".  Apparently the insurance companies are expected to pony up the funds to offer free contraception and abortifacients to all religious organizations without passing on the cost to the employer.  Riiiiiight.  There's no chance in the world that they will pad their premiums to offset the cost, ultimately passing the cost on to the protesting employer anyway, is there?  Things like that just never happen.  Obama's compromise is his ironclad bond, right Bart Stupak?  And, in typical fashion, this 'compromise' is not negotiable.   Take what they give us and be happy, right?

He seems to have grossly underestimated the intelligence of the American catholic with this one, 'cause they're not buying it.

Americans across the board should be outraged by this trampling of our first amendment rights.  And everyone, regardless of party, should consider this action when they are considering Obama's reelection.  If he is willing to hold the line on a blatantly unconstitutional action like this in an election year, what will he be willing to do over the next four years, when reelection is no longer an issue?

UPDATE:  An interesting development in the question of the legality of the mandate.  Ed Whelan and David Rivkin of the Wall Street Journal argue that the mandate is in violation of existing law, namely the Clinton-era Religious Freedom Restoration Act.  The ways in which the new mandate violates the RFRA are far too numerous to cover in an update, so get the whole story here.

LET THE GAMES BEGIN!

Senator Harry Reid has apparently decided that, in the absence of Pelosi's leadership, he is going to step up to the post of top congressional dictator.  He and a few senior senators have taken it upon themselves to attempt to dictate to the House what laws they can and cannot pursue.

In a letter to Speaker Designate Boehner, Reid, Schumer, Durbin, Murray and Stabenow all "warned" Boehner not to attempt to repeal Obamacare, particularly the so-called "donut hole" provision.  Or else.

Speaker Boehner has responded with a terse, 65-word response (via The Hill):

Senators Reid, Durbin, Schumer, Murray and Stabenow:

Thank you for reminding us – and the American people – of the backroom deal that you struck behind closed doors with ‘Big Pharma,’ resulting in bigger profits for the drug companies, and higher prescription drug costs for 33 million seniors enrolled in Medicare Part D, at a cost to the taxpayers of $42.6 billion.

The House is going to pass legislation to repeal that now. You’re welcome.

Oh, this year is going to be fun!

NOW THAT'S WHAT I CALL LAME

In a highly successful attempt to put the "lame" in 'lame-duck session', the Senate has illustrated once again why years of service do not necessarily add up to competence.

Yesterday, Senators were patting themselves on the back and touting their latest accomplishment, S510 - the FDA Food Safety Modernization Act.  They sent out press releases and crowed about the bill practically being of a historic nature (aren't they all, these days?) because it is apparently one of the most major pieces of legislation to pass a lame-duck Senate session evah.

Today, however, the miracle bill has been sent back to chambers as unconstitutional.  Ooops!  What makes it worse is that they were purposely focusing attention on what was originally an obscure bill so that they could toot their own horns and score a few political points.  If it had been allowed to continue unheralded, they could have quietly pulled it back with no egg on their faces.

In Section 107 there is a set of fees, which are classified as revenue raisers.  According to Article 1, Section 7 of the Constitution, only the House can create tax provisions.  The House holds the purse strings, not the Senate, and the Ways and Means Committee is preparting to "blue sheet" the bill, which will block it.  It's unclear whether the House will pursue a bill of their own - if they are, they'd better get cracking, because time is running out on the lame-duck session.

Perhaps there should be a requirement that our elected representatives, who swear an oath to uphold the Constitution, are actually familiar with the document.  This is Civics 101, for heaven's sake.

CONSTITUTION DAY Updated

Here is my ten-year-old daughter's contribution to Constitution Day.  She rearranged these refrigerator magnets to quite cleverly express her support of not just our founding document, but also our nation as a whole.  Can you tell she's been to a few Tea Parties?

That's my girl!

UPDATE:  Big thank you to Michelle Malkin for linking to this post via her Twitter page!!!  It's a thrill to have someone I watch and admire not only respond via email but want to send her followers to one of my links!  Thanks Michelle - you rock!

CHURCH AND THE STATE OF IOWA

This week in Davenport, Iowa, the City Administrator, Craig Malin, sent a memo to city employees announcing that the term "Good Friday" would officially be known as "Spring Holiday".   This has ignited a firestorm of criticism that caused the city council (who were not given the opportunity to vote on the change) to overrule the decision and restore Good Friday.

The argument used for this change was, of course, the old liberal favorite - "separation of church and state".

It's time to set the record straight on this once and for all.  The liberals are fond of saying that the term "separation of church and state" is in the Constitution.  It is not.  The only mention of church and state in the Constitution is this:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof."

What that means is that the State is not allowed to impose a state-run religion on the people. or regulate how, what or where they worship.  The reason they added this language was because in England, the State runs the Church.  The situation with the Church of England has been a bone of contention amongst the British for centuries - one need look no further than  Henry VIII  and his daughter, "Bloody" Mary for proof of that. There are plenty of examples throughout european history as well, such as a little thing called the Spanish Inquisition.   Throughout history, state imposed religion in european countries has caused bloodshed and power struggles time and time again.

Our founders wanted to avoid the rise of one particular religion over the others as well as avoiding having the state control or mandate worship.  But at no point in time did they want no religion whatsoever.  Our founders were almost all practicing christians of some form or another and believed that faith in God was necessary to good governance.  God is all over the founding of our nation, from the four times He was mentioned in our Declaration of Independence to the numerous mentions in our Constitution.  "In God we trust" was emblazoned not just on our money, but also over the Speaker of the House in the US Capitol.  God is in our Pledge of Allegiance.  Throughout our Capitol, there are countless references to God and the Bible on monuments and state buildings - the Supreme Court building has a relief of Moses and the Ten Commandments on the east entrance and throughout the building (no matter how they try to spin it).  One of the first books our new nation printed was a bible, which was sponsored by Congress and was actually printed to be used in schools as a textbook.  Our representatives must swear, on a bible, an oath of office that ends with "So help me God" before taking office.  The Supreme Court, in 1892, gave us the "Trinity Decision" which stated that "this is a Christian nation".  Over and over again, the Judeo-Christian ethic is shown to be a founding principle of this country.

The reason the left is desperate to rid the state of religion is twofold.  First, if God is in our government, it follows that there should be morality, accountability and ethics, too - things that are sorely lacking these days.  Second, the progressives want government to be god.  This desire has become quite evident.  When our Founding Fathers created our government, they understood that rights were things only God could bestow.  Our current government, however, in it's current incarnation as "god" has taken to bequeathing new "rights" on the people (more on "rights" in a minute).  They invoke the Constitution, even as they trample on it, in their arguments against religion; but, as usual, they misinterpret it.  Perhaps they should try reading it sometime.  In fact, it should be a requirement of federal office that a thorough knowledge of the Constitution be proved prior to being sworn in.  Many of our recent officeholders (on both sides of the aisle) find it easy to sidestep our founding document due to their complete ignorance of it.

As to "rights", a right is something inherent - endowed by our Creator, not by man or government.  It is something everyone has without having to deprive someone else of something.  The right to free speech is a God given right, as are the rights to life and liberty.  Owning a home or car, or getting a college education or health insurance are privileges.    Our government is trying to sell us on the idea that those things are rights, because then they can play at being the benevolent 'god' and dole those things out to us as they see fit.  And let's not forget - that which has been given by man can always be taken away.  It is about power and control, ultimately.

So the next time some lefty spouts off about "separation of church and state", set them straight.  Tell them to read the Constitution before they try to invoke it, and not spin it to fit their theories.  Suggest, too, that they research the backgrounds of our Founding Fathers - knowing the men who created our country and the times in which it was created are very important to understanding our founding documents.  Explain that the so-called "separation" was to protect the church from state control, not to protect the state from church control.  It's well past time to set them straight and stop their revision of our history.

In the meantime, is anyone up for a rousing rendition of "God Bless America"?

LET'S HEAR IT FOR JERSEY

A three judge panel just ruled in favor of a NJ Tea Party group stating that they have the right to try to recall one of their senators.  The ruling doesn't allow them to pursue recall just yet, however.  The case is pending appeal.  Up for debate is the constitutionality of recalling a federal elected official, Sen. Robert Menendez (D-NJ).  Apparently there is no provision for such an action in the United States Constitution, no matter whether the tea partiers get the state required 1.3 million signatures from constituents or not, so the court is expecting a challenge and will not allow the Tea Party to start proceedings.

One would like to think that the people of a state could recall their own representation, but it seems there's never been a need for that option before.  This is a major case that bears watching.  If the courts finally rule that recall is possible, there is the potential that some of the other 8 states that have recall legislation might follow suit.

There is another school of thought that recall is, in fact, provided for - in the state's constitution.  According to the Recall Congress Now website, the people of New Jersey:

...reserve unto themselves the power to recall, after at least one year of service, any elected official in this State or representing this State in the United States Congress. The Legislature shall enact laws to provide for such recall elections.

The United States Constitution is silent on this matter.  Because there is no provision for recall in the US Constitution, deference will hopefully be paid to the will of the state in question.  If so, New Jersey's constitution certainly provides for it.

It is interesting that there is no provision for recall in the Constitution.  Considering how protective our Founding Fathers were of states rights, it seems odd that they are silent.  Could it be that they were continuing in the same vein of protecting the states rights by leaving it up to them to make legislation on the subject?

Crazy talk, I know.

The real question now is, will this case be resolved in time to make it worthwhile?  In the meantime, congrats Tea Partiers of New Jersey - keep fighting the good fight!

MEET THE ENEMY

This is great. We have met the enemy, and he is us.

The democrats, in their desperation at the situation in Massachusetts, have come out with a smear ad attacking Scott Brown's scary, shadowy, fringe (apparently possibly satanic) moneymen (via Weasel Zippers):

SCOTT BROWN’S DEAL WITH THE DEVIL

Will Republicans Sell Out To National Tea Party Movement Backfire At Home?

And If He’s Elected, Who Will He Owe?

“Scott Brown made a deal with the devil – and he should have held out for a better one…Brown’s embrace of radical tea party groups for funding coincides nicely with his willingness to accept the millions in television ads from shadowy out-of-state organizations with links to Karl Rove…”
Ooooooooh.....scaaaaarrrrry! (Which is scarier - the devil or Karl Rove?  trick question - Karl Rove is the devil, silly!)   How dare Brown?!  Who did he sell out to?  Who will he owe?

Um, the American People, you liberal idiots.

How did Brown make $1.3 million in 24 hours?  Small donors.  Coakley, on the other hand?  Health care industry lobbyists.  But Brown is the shady one with ulterior motives.  Riiiight....

Perhaps if Brown's opposition at the DNC took a few minutes to read the Constitution, they would finally understand that the American people are exactly who he should 'sell out to' and most certainly the only ones he should 'owe'.
